Crowd Math - Terms & Conditions

By downloading or using Crowd Math ("the App"), you agree to these Terms & Conditions. Please read them carefully before using the App.
1. Intellectual property
The App and all associated trademarks, copyrights, and other intellectual property rights belong to Squeakbyte LLC. You may not copy, modify, reverse-engineer, decompile, or create derivative works of the App or any part of it.
2. Nature of the App
Crowd Math is a mental arithmetic practice tool. It asks addition, subtraction, multiplication and division facts and tracks how quickly and accurately you recall them.
It also has two modes for two people sharing one phone. These are local only: two players sit at either end of the same device. There is no online play, no matchmaking and no way to play against anybody who is not in the room. Nothing answered in either mode counts toward anybody's practice history, because answering under competitive pressure is not the same as recalling a fact and the App will not treat it as though it were.
The App is a practice aid. It is not a curriculum, a tutor, or an assessment. The figures it reports, including mastery, recall speed and accuracy, describe how you performed inside the App and are not a measure of academic ability, nor a substitute for teaching. Squeakbyte LLC makes no guarantee about learning outcomes.
3. Your data
The App stores your practice history and settings, and syncs them to your own private iCloud account using Apple's CloudKit service. That data is held by Apple under your Apple Account. Squeakbyte LLC does not have access to it, does not collect it, and does not transmit it to any third party.
The App supports more than one player on a device, and you may give each player a name. A name is optional and is yours to choose. It is stored with that player's history in your own private iCloud and is never sent to Squeakbyte LLC. You are responsible for what you type, and you should not enter anything you would not want stored on your own device.
A guest can play without being one of your players. A guest's answers are held on the device only, are limited in number, and are cleared after thirty days unless you keep them as a new player.
The App also sends anonymous, aggregate usage counts to help us improve it. These contain no personal information, and we have no way to identify you from them. You can turn them off at any time in the App's settings.
After a daily challenge you can share a picture of the result through the standard iOS share sheet. The card carries the day and the score and no name, and it goes only where you send it; Squeakbyte LLC is not involved and receives nothing.
You are responsible for maintaining the security of your device and your Apple Account. Anyone with access to the device can see and play as any player on it; the App has no per-player password and does not pretend to be a security boundary. You can delete all of your data, including every player and anything synced to iCloud, from the App's settings; once deleted, Squeakbyte LLC cannot recover or restore it.
4. In-app purchases
Crowd Math offers a single one-time purchase that unlocks the paid features. It is not a subscription: nothing renews, and you are not charged again.
The unlock belongs to the device and its Apple Account, not to an individual player, so every player set up on that device shares it. It supports Family Sharing where enabled on the product.
The price is shown in the App before you buy and varies by region. Payment is charged to your Apple Account when you confirm the purchase. The unlock is tied to that Apple Account, and you can restore it on another device with Restore Purchase on the paywall.
All purchases are processed through Apple and are subject to Apple's terms. Squeakbyte LLC reserves the right to change pricing or the features included at any time. Purchases are non-refundable except as required by applicable law or Apple's refund policies.
5. Availability and updates
Squeakbyte LLC may update, modify, or discontinue the App at any time without prior notice. We do not guarantee that the App will always be available, error-free, or compatible with your device or operating system version. You are responsible for keeping your device updated and accepting App updates when available.
6. Internet connectivity
Making or restoring a purchase and syncing with iCloud require an active internet connection. Practicing works offline, and anything you do offline syncs when a connection returns. Squeakbyte LLC is not responsible for reduced functionality due to lack of connectivity. Any data charges incurred through your mobile network provider are your responsibility.
7. Limitation of liability
To the maximum extent permitted by applicable law, Squeakbyte LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of or inability to use the App. The App is provided "as is" without warranties of any kind, express or implied.
8. Changes to these terms
Squeakbyte LLC may update these Terms & Conditions from time to time. Updated terms will be posted within the App or on our website. Continued use of the App after changes constitutes acceptance of the revised terms.
9. Governing law
Squeakbyte LLC is based in Seattle, Washington, United States. These Terms are governed by the laws of the State of Washington, without regard to its conflict of law rules, and any dispute that reaches a court will be heard in the state or federal courts located in King County, Washington.
Crowd Math is available worldwide, and the law where you live may give you rights that an agreement cannot take away. Nothing in these Terms removes or limits those rights. Where the mandatory consumer protection law of your country of residence conflicts with anything here, including the disclaimers in Section 7, that law applies to you and the rest of these Terms continues in force. If you are a consumer in the European Union or the United Kingdom, you keep the protections of the law of your home country and may bring proceedings in your local courts.
Purchases are made through Apple, which is the seller of record in most territories, and are also subject to Apple's own terms and to the consumer rights that come with them.
